PRIVACY POLICY GONDEK SP. Z O.O.

This privacy policy describes the principles of processing and protection of personal data collected and processed as part of the use of the gondek.com.pl website, including the principles of collecting and processing cookies.

DEFINITIONS

The terms indicated below and appearing in this privacy policy have the following meanings:

DATA ADMINISTRATOR

The administrator of personal data relating to the user, collected and processed in connection with the user’s use of the website, is Gondek sp. z o.o.

The administrator collects users’ personal data via forms available on the website (contact, registration, newsletter, other).

Personal data collected by the Administrator include:

for the purpose of using the contact form – e-mail address; name and surname

for the purpose of using the registration form – e-mail address, name and surname, address, telephone number; business data (company name, registered office address, NIP number, possibly delivery address)

for the purpose of using the newsletter form – e-mail address

PURPOSES OF DATA PROCESSING

The administrator processes personal data regarding the user for the purposes and based on the legal bases indicated below:

when processing is necessary to perform a contract to which the Administrator and the user are parties, or to take action before concluding a contract, i.e. based on Art. 6 section 1 letter b GDPR –

fulfillment of obligations arising from the contract, including execution of orders,

contacting the user who is a party to the contract,

providing services electronically in the form of registering an account on the website and providing portal functionality,

complaints service.

when processing is necessary to fulfill the legal obligation imposed on the Administrator, i.e. based on Art. 6 section 1 letter c GDPR – making settlements, keeping accounting,

when processing is necessary to achieve the purposes arising from the legitimate interests of the Administrator, i.e. based on Art. 6 section 1 letter f GDPR:

answering questions sent using the contact form,

conducting direct marketing of the Administrator’s products and services, including by sending the ordered newsletter,

establishing, pursuing or defending claims.

COOKIES AND OTHER TECHNOLOGIES

Cookies are small files saved on the user’s end device while using the website. Using the website involves collecting cookies by the Administrator.

The administrator collects cookies in two ways: (1) through the website, which collects and saves information only about recently viewed products (approx. 10 recently viewed products); (2) through integration with external tools, as a result of which data is collected via the website on the terms specified by third parties indicated in point 4.9 of this policy.

Cookies enable the Administrator to adapt the website and the offer to the user’s needs and interests.

The information in collected cookies may constitute data regarding the user’s visit to the website, including in particular his IP address, domain name and browser, and information about the operating system of the user’s device.

The administrator uses the indicated cookies to:

facilitating the user’s use of the website, including maintaining the user’s session on the website, remembering settings, etc.;

Session cookies are stored on the user’s device until the end of the session, i.e. until the user logs out or leaves the website. Persistent cookies are stored on the user’s end device for a specified period of time (from 1 month to 2 years) or until they are deleted from the end device.

The Administrator reserves that deleting or disabling the collection of certain types of cookies may result in incorrect operation of selected parts of the website and impair the quality of using the website. This effect is caused by the structure of the website and the dependence of the functioning of its selected parts on the information contained in cookies (e.g. the function of remembering login data between sessions will not function properly after disabling the collection of session cookies).

RIGHTS REGARDING DATA PROCESSING

The user has the following rights in relation to personal data concerning him:

the right to information – the user has the right to obtain information about the processing of personal data concerning him or her by the Administrator;

the right to access data – the user has the right to obtain information from the Administrator whether his or her personal data is being processed and to obtain access to it;

the right to rectify data – the user has the right to request the Administrator to immediately correct incorrect data concerning the user; in addition, the user has the right to request that the Administrator complete incomplete personal data concerning the user;

the right to delete data (“right to be forgotten”) – the user has – in the cases specified in Art. 17 section 1 GDPR – the right to request the Administrator to delete personal data relating to the user;

the right to limit processing – the user has the right to request from the Administrator to limit the processing of data relating to the user, in the cases indicated in Art. 18 section 1 GDPR; in this case, the Administrator may process personal data relating to the user (apart from storage) only with the user’s consent or in order to establish, pursue or defend against claims, or to protect the rights of another natural or legal person, or for important reasons of public interest of the Union or Member State;

the right to transfer data – the user has the right to receive data concerning him from the Administrator in a structured, commonly used, machine-readable format, as well as the right to send the above-mentioned data. data to another administrator if the processing is carried out in an automated manner;

the right to object to data processing – the user has the right to object to the processing of his or her data for reasons related to the user’s particular situation, if the data are processed for the purposes of performing a task carried out in the public interest or resulting from the legitimate interests of the Administrator;

the right to withdraw consent – the user has the right to withdraw consent to the processing of personal data if it constitutes the basis for data processing by the Administrator, and the withdrawal of consent does not affect the lawfulness of the processing carried out before the withdrawal of consent;

the right not to be subject to automated decision-making – the user has the right not to be subject to decisions based solely on automated data processing, in particular profiling, except for the situations indicated in Art. 22 section 2 GDPR (e.g. the basis for processing is the user’s consent);

the right to lodge a complaint with the supervisory authority – the user has the right to lodge a complaint with the supervisory authority (in Poland it is the President of the Personal Data Protection Office) if he/she considers that the processing of personal data concerning him/her is in violation of the provisions of the Regulation.

The User may exercise his/her rights by sending an appropriate notification to the following address: gondek@gondek.com.pl or in writing to the following address: GONDEK Sp. z o. o., ul. 3 Maja 14, 34-143 Lanckorona or via the contact form available on the Administrator’s website. The report should include information enabling verification of the user’s identity.

In order to lodge a complaint with the supervisory authority, please send an appropriate notification to the President of the Personal Data Protection Office (more information is available at https://uodo.gov.pl/).

DATA PROCESSING PERIOD

The Administrator processes personal data for the period necessary to achieve the purposes for which the data was collected, in accordance with applicable law; then the data is stored for the purposes, to the extent and for as long as required by law, including the establishment, investigation or defense against claims.

If personal data are processed on the basis of the user’s consent, the Administrator processes them until the consent is withdrawn, and the withdrawal of consent does not affect the lawfulness of the processing that was carried out before its withdrawal.

If personal data are processed on the basis of the legitimate interest of the Administrator, processing continues until an objection to this processing is raised, subject to the exceptions indicated in Art. 21 section 1 GDPR.

DATA PROTECTION MEASURES

The Administrator applies technical and organizational measures designed to protect personal data against breaches.

The measures used by the Administrator include: securing IT systems with antivirus programs, implementing security procedures, and encrypting connections using the SSL protocol.

DATA RECIPIENTS

The administrator uses the collected personal data in accordance with the purposes indicated in this policy.

The Administrator may transfer the collected personal data to the following categories of recipients: hosting providers, commercial agents, postal operators, couriers, entities providing hosting/server services and entities from the IT industry, entities providing legal services and debt recovery services.

Customer data may be made available to entities authorized to receive them under applicable law, including competent judicial authorities. Customers’ personal data may be transferred to third parties in cases indicated by GONDEK Sp. z o. o. and with the consent of customers.

DATA TRANSFER TO THIRD COUNTRIES

The Administrator does not currently transfer the user’s personal data to third countries (located outside the European Economic Area).

If a decision is made to transfer data to a third country, the user will be informed accordingly about the principles and purposes of such transfer.

CHILD PROTECTION

The content on the website is not intended for persons under 18 years of age.

If the Administrator receives information about the transfer of data relating to a person under 18 years of age, he will immediately cease processing such data, delete it and call the recipients of the above-mentioned data. data for the same.
